DOE: shoreline permits required
for transient rentals

Almost a year after the county adopted its Shoreline Master Program amendments, it received the state Department of Ecology's review. The DOE recommends approval provided the county makes two changes.

Under the county's SMP, conversion of a guesthouse or main residence for transient rentals did not require a shoreline use permit. Construction did require a such a permit. DOE instructed the county to require shoreline use permits for both conversion and construction.

The other change involves common areas in land divisions and multiple and multi-family developments. The county gives developers two ways to meet the common area requirements. The first option requires a common area of 75-feet along the waterfront property to be developed. DOE wants the common area to be along the entire waterfront of the property. To the first option, DOE also added:

A minimum of one and one-quarter acres within shoreline jurisdiction, exclusive of the common area, shall be provided for each unit to be located within the shoreline jurisdiction. This is not a minimum lot size, however, and shall not preclude clustering of units within the shoreline jurisdiction.

In the second option, DOE struck wording allowing part of a conservation tract to count toward the common area and added the words in bold: . A minimum of two acres exclusive of the common area shall be provided for each unit to be located within the shoreline jurisdiction.

The county has 30 days to respond. Alan Marriner, deputy prosecutor, spelled out the county's choices. The BOCC can

  • accept one or both changes
  • propose new amendments
  • withdraw amendments.

The BOCC will discuss their response at 1:30 p.m. Oct. 16 during their regular Tuesday meeting.
