Friends Wins Battle for Westcott Bay
before the Supreme Court

posted 12/08/00
Yesterday, in the seventh consecutive denial, the Supreme Court upheld the Appellate Court ruling that a jumbo dock for the Bellevue Farm Owners Association violated the San Juan County Shoreline Master Program. "After a six-year battle, defending the County's decision to protect the natural and scenic resources of Westcott Bay, we are elated at the news from the Supreme Courts, " said Tom Owens, President of the Friends of the San Juans. "There is not going to be a giant dock in Westcott Bay, it's over," he continued. Ending the lengthy legal battle fought by Friends of the San Juans, this decision by the Supreme Court finally puts a stop to the proposal for a 345-foot dock to bridge the tide flats of Westcott Bay.

Westcott Bay is the first site in the county proposed for special protection as a Marine Habitat Management Area under the County's new comprehensive plan. The bay is home to a heron rookery, herring continue to spawn along its wild shores, and it is world famous for its abundant oysters, clams, mussels, and crab in addition to other sea life.

"This is a landmark victory for our shorelines," said Lynn Bahrych a member of the Board of Directors of the Friends of the San Juans. "The Westott Bay case sets a precedent for the protection of the natural beauty and nearshore habitats of not just San Juan County, but for all shorelines of statewide significance in Washington," she continued.

This victory could not have been possible without the overwhelming support from the hundreds of true Friends who stepped forward to help keep the islands free from mainland scale development to protect the rural island quality of life.

"The strength of this great organization is in our dedicated citizen-based membership. This case exemplifies that strength, showing what the persons who love and respect these precious islands can accomplish when we unite to defend our island environment," said Kevin Ranker, Executive Director of the Friends of the San Juans. Hundreds of hours by many different people and foundations have been invested in protecting the special bay.

Again, the outstanding legal representation of Seattle attorney Peter Eglick carried Friends to this victory. "Peter is one of the best attorneys in the land. He is a true 'Friend' of the San Juans," said Kevin Ranker. "We are really fortunate to have such expert legal representation". Peter Eglick successfully represented Friends of the San Juans at every one of the seven appeals of this case.
