My head is spinning thinking of what Tuesday’s local election results mean for the future of the Critical Areas Ordinance (CAO), and I fear that we are now at the point of no return where a misstep by the County will lead to untold economic waste.

In 2010, the Common Sense Alliance (CSA) funded a study that evaluated six soil samples from six residential parcels on San Juan Island. Two additional soil samples were taken from two undeveloped parcels. According to some, this report shows that residential development does not generate pollutants that can negatively impact our wetlands and our fish and wildlife. There are multiple flaws in this CSA-funded study.

As a concerned citizen and property owner in San Juan County, this CAO has been driving me nuts. As I think about it and observe the document coming to completion, I am left with a few thought. Let me state out right that I oppose this ordinance for a number of reasons, mostly because the Best Available Science is so subjective and no one has been able to definitively show that there really is a problem! The Growth Management Act states the CAO should be updated if there is a need or problem.

Clearly, the feathers of the Friends of the San Juans are quite ruffled about the wave of citizen opposition to the ill-conceived CAO revisions proposed by our planning department. Their complaints about evil, outside agitators are vaguely reminiscent of the McCarthy era's guilt-by-association and "Communist under every bed" memes. People are confused and frightened by CAO misinformation. At a recent meeting, the organizer said that standing water of 100 square feet will make your property unusable. The truth is that 100 square feet of wetland will not make your property unusable.

As a land surveyor and land use permit consultant I worked with the County's property development rules from their inception in the 1970s until my retirement in 2009. During this period I worked with dozens of property owners in the successful development of their property, while respecting our beautiful environment. During this period we saw the advent of the Shoreline Master Program, the Comprehensive Plan, the Growth Management Act, and frequent periodic updates of all the attendant rules.
