At a prehearing conference the Western Washington Growth Management Hearings Board created seven categories of issues in the appeals of San Juan County's Critical Areas Ordinance (CAO).

The county's response, at almost 100 pages with about 1000 citations covering about 100 issues, is the most complete statement of the controversy over the CAO according to San Juan County Prosecuting Attorney Randall K. Gaylord.

Judge's decision on May 7

Google Earth aerial photographs were used to obtain a search warrant after numerous unsuccessful efforts to obtain Errol Speed's permission to visit his Orcas Island property to follow up on a complaint of a suspected unpermitted single-family residence.

Speed was subsequently charged with three misdemeanors and one gross misdemeanor - providing false statements or misleading statements to a public servant (the county assessor).

San Juan County Prosecutor's office released the records former employee argued were not subject to Washington state's Open Public Records Act after a request was made by the media. George Johnson took his case all the way to the state Supreme Court which declined to review the case. The records are part of his lawsuit against the county which pertains to the termination of his employment as Information Services Manager.

At an arraignment held December 16, 2011 at the Island County Courthouse in Coupeville, Washington, Colton Harris-Moore, age 20, of Camano Island, Washington, pleaded guilty to 17 felony counts of burglary and theft committed in San Juan County. Because the pleas were part of a plea agreement with Washington prosecutors, the court proceeded immediately to sentencing.

"Google is an agency of the government," said Attorney Lawrence Delay March 20 as he explained to San Juan County District Court Judge Stewart Andrews why a search warrant was invalid. The satellites used for Google Earth images were launched by the government and therefore none of the evidence can be used to obtain the warrant, he said.

PRESS RELEASE: Former County Information Services Manager George Johnson and the Washington Counties Risk Pool have reached settlement terms on Johnson’s lawsuit alleging that his August 23 dismissal from the County was retaliatory. Johnson receives $105,000 and his attorney, Jack Sheridan of Seattle receives $145,000 in legal fees.

PRESS RELEASE: Budget cuts in in March 2012 will force San Juan County Prosecuting Attorney Randall K. Gaylord to lay off the one deputy prosecutor handling misdemeanors from full-time to about half-time.

"This 50 percent reduction in misdemeanor prosecution will disrupt what people expect in public safety," said Gaylord.

"This case is a tragedy," said Island County Superior Court Judge Vickie Churchill. "And a triumph of the human spirit in other ways." She noted Colton Harris-Moore grew up with a "mind-numbing absence of hope". Churchill spoke about the damage done to the victims before pronouncing sentence.

She sentenced Colton Harris-Moore to 87 months in prison for the 31 crimes he committed during a three-year crime spree. The 20-year-old will not receive any credit for the 18 months he has served. And while he will remain in custody, the clock won't start ticking on the 87-month sentence until he turns 21.

In a little over 30 minutes this morning, Colton Harris-Moore, 20, plead guilty to 30 criminal charges and took an Alford plea on the 31st bringing to a close a three-year crime spree. Sentencing is taking place this afternoon in the Island County Superior Courtroom presided over by Judge Vickie Churchill. The proceedings are being streamed live.
